If you were convicted and found guilty, your record cannot be expunged. Only the governor can grant an absolute pardon of your conviction to you. It is extremely rare for this to happen.
The Expungement Process In Virginia
We will prepare a petition and file it with the court. The petition explains the facts of your case, why you are eligible for an expungement and what you are asking the court to do. Included in the summary of the facts of your case are the following:
- The date of your arrest
- Possession of narcotics
- A certified copy of your arrest warrant
- The department or agency making the arrest
- The exact charges to be expunged

If the judge agrees that your arrest and charges should be expunged, the court will send the decision to the Virginia State Police. The State Police will remove the charges from their records and inform us that they have done so.
